TOWSON SWIM CLUB APPLICATION POLICY

  1. By submitting an Application and paying the Application Fee, the named Applicant has applied for membership in Towson Swim Club, a proposed membership based community pool being developed by Towson Swim Center, LLC. Towson Swim Club is expected to begin operating on Memorial Day weekend 2012.
  2. A Membership Reservation number will be issued to the applicant upon the receipt of both a completed Application and Application Fee. Membership Reservation numbers are assigned in the order in which Applications are received. Returned checks are subject to a $25.00 reprocessing fee.
  3. Membership is guaranteed for only the first 400 Membership Reservations issued. Any subsequent Applications will be placed on a waiting list, and the Application Fee will be returned to the Applicants.
  4. Applications will remain valid and Application Fees will be fully refundable to Applicants until December 1, 2009. Prior to that date, if in its sole discretion Towson Swim Club has not obtained a sufficient number of Membership Reservations, or otherwise determines the construction and operation of the proposed pool is infeasible, the Application Fees shall be returned to the Applicants and each party shall have no further obligation to the other.
  5. A membership offering prospectus, including a detailed plan of the pool facilities, a description of the pool amenities, the Rules and Regulations, the cost and terms of the Membership Certificate ($1975) and the projected 2011 Annual Dues for each membership level (Individual, Couple, Household, Senior, Patron) will be provided to each Applicant after November 1, 2009. Applicants will have the opportunity to cancel their Application and to receive a full refund of the Application Fee prior to December 1, 2009 if they are not satisÞed with the terms and conditions of the Membership Offering.
  6. In the event of a conflict, this Application Policy shall take precedence over any other communications, written or verbal. The terms of the Application Policy may be modiÞed by Towson Swim Center, LLC at any time.
